Given that browsing the Fruit Communication Srl website involves the processing of personal data, meaning data and/or information relating to an identified or identifiable natural person—including through the use of other information—we hereby, in accordance with our founding values, as well as Article 13 of Regulation (EU) 2016/679 of 27 April 2016 ( GDPR ), wish to provide you with some information regarding such processing.

This information describes the methods of processing the personal data of users who consult the Fruit communication Srl website (hereinafter “ Site ”), accessible electronically from the page https://www.luvfiera.com.

The information contained therein, therefore, does not concern other sites, pages and/or online services, accessible via hyperlinks that may be present on the site , and referable to resources external to the Fruit Communication Srl domain, nor the processing of personal data carried out by Fruit Communication Srl in the execution of other activities and/or services provided to the interested parties, for which reference is made to the relevant information.

Who will process your data?

Your data will be processed by Fruit Communication Srl, with registered office in Noicattaro (BA), Vial G. Saponaro Sindaco snc, CF and VAT number 07969090724, in the person of its legal representative pro tempore, e-mail privacy@fruitcommunication.com , as data controller (hereinafter the “ Data Controller ”).

What data will be processed?

For the purposes indicated in this policy, the Data Controller will process the following data: 

  1. a)navigation dataThe information systems and applications used to operate the website process, during their normal operation, certain personal data whose transmission is implicit in the use of internet communication protocols. This data includes IP addresses, the domain names of the terminals used by users, the URIs and URLs of the requested addresses, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response from the server (such as error messages), and other parameters relating to the user's operating system and/or IT environment.

This data is used for the sole purpose of obtaining statistical information on the use of the Site and to enable the correct provision of the various features you request.

  1. b)data collected through Cookies. The Cookiesare text strings that allow the web server to store information relating to the visited site, to be reused during the same browsing session (session cookies) or for a specific period of time. We collect the data you voluntarily provide to us via the form “Contact us” present on the Site (such as, for example, name, surname, email address, company role held and other information that you provide us in the form) to respond to requests for information that you send us regarding our services and activities.
  1. d) identification and contact dataIf you decide to subscribe to our newsletter, we will collect your name, surname and email address via the form “Newsletter subscription"Present on the Site.

For what purposes and on what grounds do we process your data?

Your personal data will be processed for the following purposes and on the basis of the following lawfulness conditions (legal bases):

  1. Allow you to navigate the Site and check that it is working correctlyThis processing is necessary for the performance of a contract or for pre-contractual measures taken at your request. 

Providing your data for this purpose is necessary, as failure to do so will prevent you from browsing the Site and controlling its operation.

  1. Respond to requests for information about our services and activities, that you send us via the "Contact" form on the Site. This processing is necessary for the performance of a contract or pre-contractual measures taken at your request. 

You are not obligated to provide your data for the aforementioned purpose, however, failure to provide it may result in us being unable to send you information requests and process them.

  1. Send you our periodic newsletter By email, you will receive information about initiatives and events we organize, as well as articles on agri-food topics. The legal basis for this purpose is your specific consent, which you can withdraw at any time. 

Providing your data for this purpose is optional, but without it, we will not be able to send you our newsletter.

How will the data be processed?

The processing of your personal data will be based on the principles of lawfulness, fairness, transparency, purpose and retention limitation, data minimization, accuracy, integrity, and confidentiality, in compliance with the GDPR and applicable national data protection legislation. 

Your data will be processed using paper-based methods and/or with the aid of computerized and/or electronic tools.

In any case, the Data Controller undertakes to adopt the most suitable technical and organizational measures to guarantee an adequate level of security for your data and in any case to prevent risks associated with loss, even accidental, unauthorized access, modification, destruction and/or unauthorized disclosure.

Who will my data be shared with?

Your data will be processed by persons authorized and trained by the Data Controller, who will operate according to the principles of fairness, loyalty, and transparency. The confidentiality of your data will be protected through the application of appropriate technical and organizational security measures to ensure an adequate level of protection.

Your data may be shared with IT and/or telematics service providers.

These recipients have been appointed as Data Processors for this purpose pursuant to Art. 28 of the GDPR. To consult the complete list of Data Processors, please contact the Data Controller.

Your data may also be disclosed to authorities and institutions granted access to them by law or regulation (e.g., public security authorities and police forces). 

Will my data be transferred abroad?

In some cases, personal data collected through the Site may be transferred to non-EU countries due to specific requirements related to the location of some of the Data Controller's service providers. Where the third country is not subject to an Adequacy Decision from the European Commission, the Data Controller undertakes to ensure adequate levels of protection and safeguards, including contractual ones, in accordance with applicable regulations, including the stipulation of standard contractual clauses pursuant to Art. 46, paragraph 2, letter c) of the GDPR, supplemented by additional technical, legal, and organizational measures necessary to ensure that the level of personal data protection is equivalent to that of the EU.

How long will my data be processed?

We retain personal data only for as long as necessary to achieve the purposes for which it was collected or for any other related legitimate purpose. Therefore, if personal data is processed for two different purposes, we will retain such data until the purpose with the longest retention period ceases. In any case, we will no longer process personal data for the purpose whose retention period has expired.

Personal data that is no longer necessary, or for which there is no longer a legal basis for its retention, will be securely deleted.

Browsing data is deleted immediately, unless judicial authorities need it to investigate criminal offenses. 

The data required to respond to your requests for information about our services and activities will be retained exclusively for the time necessary to manage said requests and will subsequently be deleted.

The data required to send you the periodic newsletter will be processed for 24 months from the date of collection, or until you withdraw your consent, whichever is earlier. Nearing the 24-month deadline, you will receive an email allowing you to confirm your wish to continue receiving the newsletter.

What privacy rights can I exercise?

Throughout the treatment period you will be able to ask:

  • confirmation of the existence of your data and access to their content (right of access);
  • the rectification of data, where inaccurate, and integration, where incomplete (right of rectification);
  • the deletion of data, where they are processed in violation of the law or their retention is no longer necessary in relation to the purposes for which they were collected;
  • restriction of processing: i) in the event of a dispute regarding the accuracy of the data (for the period necessary to verify and, if necessary, rectify the same), ii) in the event of unlawful processing (as an alternative to the request for erasure), iii) where they are necessary for the establishment, exercise or defense of a right in court, iv) in the event of opposition (where there is a prevailing reason of the Data Controller with respect to the processing and for the time necessary to verify such prevalence) (right to restriction of processing);
  • the revocation of consent given, in cases where the processing is based on the same, without prejudice to the lawfulness of the processing based on the consent given before the revocation (right to withdraw consent);
  • where applicable, obtain a copy of the data in electronic format and request that such data be transmitted to another data controller (right to data portability).

You may also exercise your right to object at any time if the processing is based on our legitimate interest or if the processing is carried out for direct marketing purposes, such as sending our periodic newsletter. In the latter case, you may object to the processing by clicking on the appropriate link at the bottom of each promotional communication you receive.

Finally, it will be possible to lodge a complaint with the Italian Data Protection Authority (Garante per la protezione dei dati personali), or appeal to the competent judicial authority.
